Terms of Service

These Terms of Service ("Terms") govern use of the Vine ChMS church-management software and the vinechms.com website (together, "the Software" or "the Service") published by Vine Software LLC ("Vine"). By signing up for, accessing, or using the Service, the church and its authorized users agree to these Terms.

1. The Software

Vine ChMS is church-management software for managing a church's people, giving, accounting, worship planning, groups, calendar, attendance, check-in, and related ministry functions. It is delivered as a hosted service: Vine hosts and operates the platform, and each church uses its own church account at its own vinechms.com subdomain.

2. License

Subject to these Terms, Vine grants the church a non-exclusive, non-transferable license to use the Software for its own ministry and administrative purposes. The church may not resell the Software, remove proprietary notices, or misrepresent its origin.

3. Accounts and responsibilities

The church is responsible for creating and managing its staff login accounts, assigning appropriate roles, safeguarding credentials, and ensuring that only authorized people access sensitive areas such as giving, accounting, and pastoral care. The church must change the temporary password it receives at sign-up on first login. The church is responsible for all activity that occurs under its account.

4. Subscription, fees, and billing

Use of the Service requires a paid subscription. The price and billing interval are shown at checkout before you pay. Payment is processed by Stripe, and by subscribing the church authorizes Vine, through Stripe, to charge the payment method provided on a recurring basis at the price shown until the subscription is canceled. Prices are in U.S. dollars unless stated otherwise; the church is responsible for any applicable taxes.

The church may cancel at any time; cancellation takes effect at the end of the current billing period and no further charges are made after that. Fees already paid are non-refundable except where required by law or where Vine decides otherwise in writing. Vine may change its prices for future billing periods with advance notice. If a payment fails, Vine may suspend the church's account until the balance is resolved.

5. Acceptable use

Users agree not to use the Software to violate any law, infringe others' rights, transmit malicious code, attempt to gain unauthorized access to any system, or misuse personal information held in the account.

6. Donations and payments

Where a church enables online giving, payments are processed by Stripe under Stripe's own agreements. Vine does not process, hold, or disburse funds and is not a party to any transaction between a donor, the church, and a payment processor. The church is responsible for the accuracy of its own giving records and contribution statements.

7. Third-party services

Optional integrations (including Stripe, Plaid, Checkr, Text In Church, and PraiseCharts) are provided by third parties under their own terms. The church's use of any integration is between the church and that provider; Vine is not responsible for third-party services.

8. Church data

As between Vine and the church, the church owns all data it enters into its account. Vine hosts that data to provide the Service and handles it as described in the Privacy Policy. The church is responsible for its own data, including lawful handling of the personal information it collects, deciding how long to retain it, and keeping its own copies of important records using the app's backup and export tools.

9. Disclaimer of warranties

The Software is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Vine does not warrant that the Software will be uninterrupted or error-free. Financial, payroll, tax, and background-check features are tools to assist the church's own record-keeping and are not a substitute for a qualified accountant, attorney, or other professional.

10. Limitation of liability

To the maximum extent permitted by law, Vine will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or relating to the Software.

11. Indemnification

The church agrees to indemnify and hold Vine harmless from claims arising out of the church's use of the Software, its data, or its violation of these Terms or applicable law.

12. Term and termination

These Terms apply for as long as the church uses the Software. The church may stop using the Software at any time (see §4 for cancelling billing). Vine may suspend or end access for non-payment or violation of these Terms. Provisions that by their nature should survive termination (including §§8–11) will survive.

13. Governing law

These Terms are governed by the laws of the state in which Vine Software LLC is organized, without regard to conflict-of-laws principles.

14. Changes

We may revise these Terms from time to time; the effective date above will change accordingly. Continued use of the Software after a change constitutes acceptance of the revised Terms.
